The Appeal of Internal Review

Why do most welfare applicants fail to challenge adverse decisions despite a continuing sense of need?. The book addresses this severely under-researched and under-theorised question. Using English homelessness law as their case study,the authors explore why homeless applicants did -- but more often did not -- challenge adverse decisions by seeking internal administrative review. They draw out from their data a list of the barriers to the take up of grievance rights. Further, by combining extensive interview data from aggrieved homeless applicants with ethnographic data about bureaucratic decision-making, they are able to situate these barriers within the dynamics of the citizen-bureaucracy relationship. Additionally, they point to other contexts which inform applicants decisions about whether to request an internal review. Drawing on a diverse literature -- risk, trust, audit, legal consciousness, and complaints -- the authors lay the foundations for our understanding of the (non-)emergence of administrative disputes.

Begnadigungen sind keine Sache der ffentlichkeit. Whrend Strafverfahren bis zum rechtskrftigen Urteil im Interesse der Allgemeinheit gem Art. 6 EMRK ffentlich durchgefhrt werden, sind Verfahren zur Begnadigung im Sinn des Menschenrechtes auf Achtung des Privat- und Familienlebens gem Art. 8 EMRK nicht ffentlich. Wie das mediale Echo auf jngere Begnadigungen zeigt, herrscht eine weitgehende Unkenntnis ber die rechtlichen Grundlagen der Begnadigungen im Besonderen und der Staatsakte des Landesfrsten als Staatsoberhaupt im Allgemeinen. Die Staatsakte des Frsten und ihre Gegenzeichnung durch den Regierungschef werden in der vorliegenden Studie gem ihren verfassungsrechtlichen Grundlagen eingehend untersucht. Theoretische Darlegungen in der Literatur, Entscheidungen des Obersten Gerichtshofs und Erkenntnisse des Staatsgerichtshofs dienen als Wegweisungen. Fragen zu den Rechtsgrundlagen betreffend Ausfertigung und Gegenzeichnung von Staatsakten werden aus dem Wortlaut der Verfassung und gem dem liechtensteinischen Konzept von der Gewaltenteilung schlssig beantwortet. Beispiele aus der Praxis der letzten zwanzig Jahre, die bisher nicht allgemein bekannt waren, veranschaulichen nicht nur die Verfassungsrechtslage, sondern auch die Verfassungswirklichkeit.
